Terms of Service

These Terms of Service ("Terms") govern your access to and use of Mapzio, the site-planning application available at app.mapzio.de, and this marketing website (together, the "Service"). The Service is operated by Maurice Kleindienst, Weserstraße 16 A, 34125 Kassel, Germany ("we", "us"). By creating an account or otherwise using the Service, you agree to these Terms.

1. The Service

Mapzio lets you and your team draw, annotate and export site plans over satellite imagery or uploaded floor plans, and collaborate on those plans in real time. Some features are only available on paid plans as described on our pricing page.

2. Accounts

You need an account to use most of the Service. You're responsible for keeping your login credentials confidential and for all activity that happens under your account. Tell us immediately athello@mapzio.de if you suspect unauthorized use of your account.

3. Plans, billing and cancellation

The Service is offered on a free plan and several paid subscription plans, billed monthly, as described on our pricing page. By subscribing to a paid plan you authorize us (or our payment processor) to charge your payment method on a recurring basis until you cancel. You can cancel a paid plan at any time from your organization's billing settings; your subscription remains active until the end of the current billing period, and we do not provide refunds for partial billing periods except where required by law. We may change plan prices or features with reasonable advance notice; continued use after a price change takes effect constitutes acceptance of the new price.

4. Acceptable use

You agree not to:

• use the Service for any unlawful purpose or in violation of any applicable law or regulation;
• attempt to gain unauthorized access to the Service, other accounts, or the systems behind it;
• upload content you don't have the right to use, or that infringes on someone else's rights;
• interfere with or disrupt the integrity or performance of the Service, including through automated scraping;
• reverse-engineer or resell the Service without our prior written consent.

We may suspend or terminate accounts that violate these Terms.

5. Your content

You retain ownership of the site plans, uploads and other content you create in the Service ("your content"). You grant us a limited license to host, store, process and display your content solely to operate and improve the Service for you and the collaborators you invite. We do not claim ownership of your content and we do not sell it. Your content is only visible to people you explicitly invite into your organization, as described in our privacy policy.

6. Availability and changes to the Service

We aim to keep the Service available and reliable, but we don't guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue features of the Service from time to time; where reasonably possible, we will give advance notice of changes that materially affect paid plans.

7. Disclaimer of warranties

The Service is provided "as is" and "as available". To the extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Export files (including permit-related exports) are provided as a convenience — you remain responsible for verifying that any submission meets the requirements of the authority, venue or client you're submitting it to.

8. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special or consequential damages arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve months preceding the claim. Nothing in these Terms limits liability that cannot be limited under mandatory German law, including liability for intent, gross negligence, or injury to life, body or health.

9. Term and termination

These Terms apply for as long as you use the Service. You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms and don't remedy the breach after being notified, or where required by law.

10. Changes to these Terms

We may update these Terms from time to time to reflect changes to the Service or legal requirements. We'll post the updated Terms here with a new "last updated" date; material changes will be communicated to account holders by email or in-app notice before they take effect.

11. Governing law

These Terms are governed by the laws of Germany, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, mandatory consumer-protection provisions of your country of residence remain unaffected.
